Welcome to Start With You. These Terms of Service ("Terms") govern your use of the website startwithyou.ventures, bookings.startwithyou.ventures, and all related services provided by Start With You, LLC ("Company," "we," "us," or "our"). By accessing our website or booking our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Services Overview

Start With You provides professional photography services, including but not limited to:

Professional headshots (including ERAS headshots for medical professionals)
Portrait photography
Pet photography
Food photography
Wedding photography
Group sessions
Mini-sessions
Photography workshops and events

Booking and Scheduling

Booking confirmation: a session is confirmed only after a booking retainer or full payment has been received through our booking system.
Session details: specific session details, including date, time, location, and package selected, will be confirmed via email or through the booking platform.
Arrival and preparation: clients are expected to arrive on time. Late arrivals may result in a shortened session, and the session fee will not be adjusted.

Payments and Pricing

Pricing: all prices are listed on our website and booking platform. Prices are subject to change without notice, but confirmed bookings will be honored at the price quoted at the time of booking.
Payment methods: we accept payments processed securely through Stripe. By making a payment, you agree to Stripe's terms of service (https://stripe.com/legal).
Retainer fees: certain sessions may require a non-refundable retainer fee at the time of booking to secure your session date.
Full payment: remaining balances are due on or before the session date unless otherwise agreed in writing.

Cancellation and Rescheduling

Client cancellations: if you need to cancel, please notify us at least 48 hours before your scheduled session. Retainer fees are non-refundable. Sessions cancelled with less than 48 hours notice will be charged the full session fee.
Rescheduling: sessions may be rescheduled at least 48 hours in advance, subject to availability, at no additional cost for the first reschedule. Subsequent reschedules may incur a fee.
Photographer cancellation: in the rare event that we must cancel a session, we will offer a full refund or reschedule at no additional cost.
Weather and force majeure: outdoor sessions affected by inclement weather will be rescheduled at no cost to the client. Neither party shall be liable for cancellations caused by events beyond reasonable control (natural disasters, government restrictions, pandemics, etc.).

Intellectual Property and Copyright

Ownership: all photographs and images created by Start With You are the intellectual property of Start With You and are protected under U.S. copyright law. The photographer retains full copyright ownership of all images.
Client license: upon full payment, clients receive a limited, non-exclusive, non-transferable personal use license to use the delivered images for personal purposes (e.g., social media profiles, printing for personal display, professional headshot use).
Commercial use: use of images for commercial purposes (advertising, resale, merchandise, etc.) requires a separate written license agreement and may involve additional fees.
No alterations: clients may not alter, edit, add filters to, or otherwise modify the delivered images without prior written consent from Start With You. This includes but is not limited to cropping, color changes, and applying social media filters.
Credit and attribution: when sharing images on social media or other platforms, clients are encouraged to credit Start With You (e.g., @startwithyoullc or startwithyou.ventures).

Model Release and Portfolio Use

Portfolio use: Start With You reserves the right to use photographs from your session for portfolio, marketing, social media, website display, and promotional purposes unless you opt out in writing prior to or at the time of your session.
Model release: by booking a session, you grant Start With You a non-exclusive, royalty-free license to use images from your session for the purposes described above, unless you provide a written opt-out request.
Opt-out: to opt out of portfolio or marketing use, notify us in writing at contact@startwithyou.ventures before or at the time of your session.

Image Delivery

Turnaround time: edited images will be delivered within the timeframe communicated at booking (typically 2–4 weeks, depending on the session type and current volume).
Delivery method: images will be delivered digitally via a secure online gallery or download link.
Image selection and editing: Start With You retains creative discretion over the selection and editing of final images. The number of delivered images depends on the session package purchased.
Raw files: unedited RAW files are not included in any standard package and are not available for purchase unless otherwise stated.

Limitation of Liability

No guarantee: while Start With You strives for excellence in every session, photography is a creative service and results may vary. We do not guarantee specific outcomes, poses, or expressions.
Equipment failure: in the unlikely event of equipment failure resulting in loss of images, Start With You's liability is limited to a full refund of the session fee paid.
Maximum liability: in no event shall Start With You's total liability exceed the amount paid by the client for the specific service giving rise to the claim.
Indirect damages: Start With You shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the services provided.

Indemnification

You agree to indemnify and hold harmless Start With You, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your breach of these Terms, your use of the images in violation of the license granted, or your violation of any applicable law.

Website Use

Acceptable use: you agree to use our website only for lawful purposes and in a manner that does not infringe upon or restrict the use and enjoyment of the site by others.
Account security: if you create an account on our booking platform, you are responsible for maintaining the confidentiality of your login credentials.
Prohibited conduct: you may not: (a) copy, distribute, or reproduce any content from our website without permission; (b) attempt to gain unauthorized access to our systems; (c) use automated tools to scrape or collect data from our website; or (d) upload harmful content or malware.

Dispute Resolution

Governing law: these Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to conflict of law principles.
Informal resolution: before pursuing formal legal action, both parties agree to attempt to resolve disputes informally by contacting contact@startwithyou.ventures.
Jurisdiction: any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Maryland.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
